NC Divorce Rules

In North Carolina, you may only get a divorce after being separated for one year or more. To be separated, the parties cannot be living together under the same roof.

This does not however, mean that there is nothing to be done during the year separation. Parties can always enter into a separation agreement which can cover separation of the marital home, assets, accounts, and even child custody.

This is a good way to take care of everything that a divorce would cover and take care of it before the actual divorce.
